Two Documents, Two Statutes

If you are stopped, two things get asked for, and they come from two different sections of the Vehicle Code with two different rules. Knowing which is which takes a minute and removes most of the anxiety.

The license

Vehicle Code section 12951 is short and unambiguous. Subdivision (a): the licensee shall have the valid driver's license issued to them in their immediate possession at all times when driving a motor vehicle upon a highway. Subdivision (b): the driver shall present the license for examination upon demand of a peace officer enforcing the code.

Immediate possession means on you or in the car. At home in a drawer does not satisfy it, even though your driving privilege is perfectly valid. A nonresident driving under the section 12502 exemption is held to the same standard for their home-jurisdiction license.

The insurance

Vehicle Code section 16028 covers the other half. A driver must provide evidence of financial responsibility on the demand of a peace officer, and at a collision scene on the demand of a peace officer or traffic collision investigator. Notably, the section provides that officers shall not stop a vehicle for the sole purpose of checking this requirement — so the insurance question arises during a stop made for some other reason, or at a crash.

Subdivision (b) adds the practical part: when an officer issues a citation for a code violation, the driver shall furnish written evidence of financial responsibility at that time, and may instead provide electronic verification using a mobile electronic device.

Use the electronic option

That last sentence is underused. Your insurance card on your phone is expressly contemplated by the statute. Insurance cards live in gloveboxes, expire, get taken out during a cleanout, and are absent precisely when needed. Your phone is with you.

Do both. Keep the paper card in the car and a screenshot or the carrier's app on your phone. A screenshot beats an app that needs a signal.

What to do when you do not have it

If you are cited for not producing evidence of insurance but you were in fact insured at the time, that is generally a correctable situation — courts commonly allow proof of coverage in force on the date to resolve it, with an administrative fee. Do not ignore the citation on the theory that you know you were insured. Show up, produce the declarations page for that date, and be done.

The genuinely bad version is not being insured. That is a separate problem with registration and licensing consequences, and it does not improve by waiting.

Make it match

One last thing worth checking tonight. Open the glovebox and read the insurance card. Does the name on it match the name on your license exactly? Is the car listed the car you are driving? Is the card current? Those three checks take ninety seconds and they are the difference between a two-minute stop and a long one.

Is a photo of my insurance card on my phone acceptable?

Vehicle Code section 16028(b) expressly allows a driver to provide electronic verification of financial responsibility using a mobile electronic device instead of a written card. Carrying both is the safest habit.

Can I be pulled over just to check my insurance?

Section 16028(a) provides that peace officers shall not stop a vehicle for the sole purpose of determining whether the vehicle is being operated in compliance with that section. The question arises during a stop made for another reason, or at a collision.

What happens if I left my license at home?
